By accessing or using the website located at powaymasonry.com (the "Site") or by requesting or receiving services from Poway Masonry ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. Poway Masonry provides residential and commercial masonry contracting services including but not limited to foundation repair, chimney repair, brick repair, tuckpointing, retaining walls, driveway pavers, stone work, concrete block walls, fireplace installation, and related masonry services in Poway, CA and surrounding communities.
The Site provides general information about our company and services. It does not constitute a binding contract or guarantee of service availability, pricing, or scheduling until a written estimate has been provided and accepted by both parties.
All estimates provided by us are based on information available at the time of the site visit and are valid for 30 days from the date of issue unless otherwise stated in writing. Estimates are not final contracts. Actual project costs may vary if site conditions differ from those observed during the initial assessment, if additional work is required beyond the original scope, or if material costs change significantly between estimate and project start.
We will notify you in writing of any material change to the estimated cost before proceeding with additional work. No additional charges will be applied without your prior written or verbal approval.
Project start dates are scheduled based on current workload and material availability. We will provide a target start date at the time of contract signing and will notify you of any delays as soon as reasonably possible.
If you need to cancel or reschedule a project, please notify us as soon as possible. Cancellations made after materials have been ordered or after work has begun may be subject to costs for materials already purchased or labor already performed.
We reserve the right to reschedule work due to weather conditions, material delays, or circumstances outside our control. We will communicate any schedule changes to you promptly.
Payment terms for each project will be specified in the written estimate or contract. Typical arrangements may include a deposit prior to project start and the remaining balance due upon project completion. Specific payment schedules for larger projects will be outlined in the project agreement.
Invoices are due upon receipt unless otherwise agreed in writing. Past-due balances may be subject to a late fee at a rate permitted by applicable California law. We reserve the right to suspend or discontinue work on a project if payments are not made in accordance with the agreed schedule.
Under California law, a licensed contractor may file a mechanics lien against the property where work was performed if payment is not received. We will exhaust reasonable communication efforts before pursuing this remedy.
We warrant that all work will be performed in a professional manner consistent with industry standards. Specific warranty terms, including duration and coverage, will be set out in the written project agreement. Warranty coverage is limited to defects in workmanship performed by our crew and does not extend to pre-existing conditions, damage caused by third parties, normal wear and tear, or conditions resulting from improper maintenance by the property owner.
The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.
To the extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable California law, our total liability to you for any claim arising out of or relating to our services or your use of the Site will not exceed the total amount paid by you to us for the specific project to which the claim relates.
We will not be liable for indirect, incidental, consequential, punitive, or special damages of any kind, including loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.
All content on the Site - including text, images, logos, and graphics - is owned by or licensed to us and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission.
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You may not use the Site to transmit spam, malware, or any content that is unlawful, harmful, defamatory, or otherwise objectionable.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising under these Terms will be brought exclusively in the courts of San Diego County, California.
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised effective date. Your continued use of the Site or our services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
